Jessica Lall’s Murder Trail : A Sister’s Fight Against The System
“We have no hesitation in holding that Manu Sharma is guilty of an offence under Section 302 (murder) of IPC for having committed the murder of Jessica Lall … as also under Section 27 of the Arms Act,” said a division bench comprising Justice RS Sodhi and Justice PK Bhashin.
Today I feel proud. I am proud of being an Indian woman.
It’™s been nearly 8 years of constant struggle against the judicial system, emotional tussle with one’s self and a strong determination for a loved one by Sabrina Lall to accomplish her objective. She has finally brought justice to her dead sister and poignant peace to her departed parents.
In today’s society where blood relations are treated as nothing more than some genetic bonding, it is heartwarming to see someone like Sabrina Lall; who practically gave up so many years of her youth, all in an effort to bring her sister’s murderer punished and put behind bars.
Though the media and the court hailed the star witness Bina Ramani for her testimony against the accused, not taking any credit from here - for me the only one who deserves praises and accolades is Sabrina Lall.
In our country, its no hidden fact that once a person is caught within the law and order web, very few manage to come out of it victoriously. Things only get uglier, when one is up against the influential or people with political backing. And to be a woman makes matters even more painful. But thankfully individuals like Sabrina Lall not only give us hope but also the courage to fight for what we believe in. There is no doubt in my mind that Sabrina’s struggle in the Jessica Lall case had a lot to do with the justice attained in the Priyadarshini Mattoo case and hopefully the same verdict one could expect in the Nitish Katara murder trail.
On the other hand, I was also glad that the division bench comprising Justice RS Sodhi and Justice PK Bhashin did not hesitate from mentioning the irresponsible nature of the trail court and judge S. L Bhayana. The high court held that Bhayana’s decision to reject the testimony of witness Deepak Bhowani not only reflects total lack of application of mind but also suggests a hasty approach towards securing a particular end, namely the acquittals. The judges also stated that the other witnesses, namely Bina Ramani, Malini Ramani and George Mailhot had said enough to prove Sharma’s guilt, but the trial court had failed to appreciate that.
It is important to note that the high court gave its verdict based on the same evidence which the trial court had felt was “not sufficient”.
Manu Sharma will be sentenced tomorrow; he is mostly likely to either get a life-term behind bars or a death sentence. Though Sabrina wishes for a jail sentence, I for one would be more pleased with the verdict of “Hanged till Death”. However Manu Sharma is eligible to appeal against the High Court’s decision at a higher court.
Agreed, this is just one case amongst the thousands collecting dust in some back cupboard drawer of a locked-up court room but as a friend remarked “A start is a start “. And hopefully many more in similar situation as the Lalls would gain some inspiration from this courageous woman and fight their battles with a brave heart.
Before I end, I would like to ask just one question to the Devil’s advocate, Mr. Ram Jethemalani, “Dude, what happened to your Red Turban Theory and when the heck are you going to reveal identity of the actual killer?”



We all have a right to express our views. In many instances; it will be against ours and in some; with us. To hear them out is 'decency' but to let them get to you is 'weakness'.

Sakshi: I like many others was just as glad to learn of the Jessica Lal Case’s Verdict and to see Manu Sharma being found guitly by the Court finally. Just a pity that it didn’t happen ‘earlier’ than this..and it took Sabrina Lal so long to fight it out but truly she must feel peace at heart after all these years, which is much deserved.
Kudos to her for that.

Ram Jethmalani is the personification of hope.
If Ram Jethmalani goes to a bar or any public place and you shoot someone infront of him, making sure he has seen the spectacle, and yeah, before shooting the person you tell Mr. World’s-Biggest-Legal-Know-All that you want to shoot someone, i thing you can be assured friend, that the Personification Of Hope will fight and stand for you with a vigour thats proportional to the size of your wallet.
And the red turban guy… He stopped wearing the turban when he heard Ram knew about the story. Now, the problem is finding him. Do you have any idea how different turbaned guys look without their turbans?

Btw, while I understand that the Jessica Lal case has finally punished the guilty, I don’t see any pride in it..
For one, as you have put it, it is not a victory for the Indian woman. This was not a case against the Indian woman; rather simply a man with political clout flouting the law..it could have happened to a man as much as to a woman like Jessica..that was for the ‘woman’ part of why you were proud of.
And coming to the Indian part, it is a pity that only such a huge media scrutiny could finally put a full-stop to so many days of injustice..It happened to Jessica..but in all probability it will not happen if you or I were the victim…

Now getting on to the other point, the reason behind me calling it a woman’s victory is simply because no many are strong enough to fight against the prejudice society and system of our country. Be it a rape case, domestic violence, workplace harassment or murder - barely do we find women coming in the open and standing up against the wrong-ones.
Not saying that it’s easy for the opposite gender but there is no denying that it’s far more worse for women.
Sabrina Lall is a role model for all Indian women and hopefully her battle will inspire many to come forward and take stand….
And the part where you talk about the media involvement, I agree it’s sad to see that we reached a positive verdict only after the immense attention given by MSM but as they say “Something is Better than Nothing”.

Manu Sharma murders one, in a drunken state, after Jessica made fun of him in front of a hundred people - he gets a life imprisonment or hanging.
Sanjay Dutt involved in murder of hundreds, allowed his home as base for Islamic terrorists and RDX, keeps weapons illegally - he probably will be let off or gets do-chaar saal kee jail.
I havent even touched the subject of Afzal Guru yet.

PS.. Note the scenario - Manu is drunk already. Manu asks for a drink, Jessica refuses. He feels insulted, the way he is refused. He whips out a gun. Someone comments - Its a fake. People laugh. He shoots.
My point is not to prove that Manu should be let off. My point is, why the unequal treatment in two different cases. If Manu had been a famous actor, would he have got a lighter sentence?

who gives a crap about jessica lal?? NDTV is an useless channel rather than concentrting on India’s historic win they were airing some stupid murder trail.
